Ahead of the May 15 implementation, the AI lab released a formal policy position suggesting specific adjustments to ensure national security while maintaining U.S. dominance in the global AI race.

Introduced by the Biden administration in January, the framework establishes a three-tier system for global chip distribution:

  • Tier 3: Countries already subject to strict controls, including Russia and China, face heightened restrictions.
  • Tier 2: Nations like Mexico and Portugal would encounter new purchase caps and export oversight for the first time.
  • Tier 1: Strategic allies such as Japan and South Korea remain exempt from these specific export barriers.

While industry giants like Nvidia previously criticized these measures as “misguided” and a potential threat to global innovation, Anthropic maintains that robust controls are essential to prevent the unauthorized proliferation of high-performance computing power.

Anthropic’s support comes with nuanced technical recommendations aimed at closing potential loopholes. The company suggests lowering the volume of chips Tier 2 countries can acquire without a formal review process. Instead, they advocate for a model favoring government-to-government agreements, which they argue would better mitigate smuggling risks and enhance U.S. oversight.
